TERMS OF SERVICE

By commissioning me (iFriskyDingo/Mystic Goblin) you agree to ALL of the terms and conditions. (1/11/2024 - present)

PAYMENT/CANCELLATION


1) Payment is due within 3 days of being confirmed for a commission slot. If payment has not been received within that time, then that spot will be forfeit.*
1a) I have to turn potential commissioners away once my plate gets full; taking a spot without paying for your piece is not only unfair to me, as art is my primary source of income, but also to those I have to turn away.
2) No part of the piece will be started before payment has cleared
3) I accept Paypal only for accepting commission payments. No exception.
3a) Venmo is used as my tip jar and tip jar only
4) No Refunds on pieces that have been started.
5) I reserve the right to change my prices as I see fit. Commissions in progress will not be affected by the price changes.
6) I have the right to cancel your commission at any time, for any reason that I see fit. If I still owe you money, you will be refunded the difference at the time of termination (ie. If you have paid for a full colored piece but I have only gotten to the line work, I will refund you the difference. Since I have already done some of the work .)

STREAM
1) I reserve the right to stream pieces at my discretion. I will not take requests to have a piece done only in the stream.
2) If you do not want your piece streamed, please let me know, preferably in the commission form so I have documentation in a reliable place.

GENERAL
1) Please have references (written, visual, or both) ready when your piece is begun. If I have to do the research for you I will charge a research fee.***
1a) Please stick to your idea and don't constantly change around what you want. It is not fair to me to have to re-skech everything 5 times because you keep changing your ideas.
2) Major changes will be allowed while a piece is in the sketch phase only.( ie, pose, positioning, etc.) I contact you throughout the art process for a reason, and if you give the go-ahead on a sketch to start the lining/coloring process, then you are agreeing to what has been drawn. Minor changes can and will still be made before the piece is finalized.
3) Please be available to discuss works in progress in a reasonable time. I understand that life can get pretty crazy, but to get your piece to you as quickly as I can, I need to be able to contact you to make sure there are no changes that need to occur.
4) Do not take my ideas to another artist. I generally sketch out rough ideas, and in some cases help a commissioner create an idea a while before their piece comes up to be finalized. If I find out you have taken these ideas and/or rough sketches to someone else, I reserve the right to remove you from my commission list and refund the difference in work done.
5) Commissions will be done in the order I see fit. It is not a first pay/first up basis unless otherwise noted
6) By commissioning me, you agree that you own full rights to all characters, settings, objects, etc., or have permission to use them from whoever does own them.
7) Reposting your commission to your account is allowed. Please post a link back to the original artwork, or post credit in your description.
8) I retain the copyright, including the rights to reproduce the original artwork, distribute/repost the image elsewhere, and use it in my portfolio/for self-promotion.

TIME FRAMES/ UPDATES

1) You have 1 month from the completion of the piece for minor changes to be made on a case-by-case basis.**
2)I try to get all owed pieces done within the month that the commission is taken, but sometimes this is not possible.
*** PLEASE ALLOW 3 MONTHS FOR THE COMPLETION OF A FULL PIECE ***
I have various illnesses including fibromyalgia and depression and this makes it difficult to draw every day, so please be patient!
3) Update requests are welcome, but please keep the number of requests reasonable.

RIGHTS AND REFUSALS

--I reserve the right to refuse service to anyone at any time.
--I reserve the right to work on personal art at my discretion.
--I retain full rights to the artwork(non-commercial use only, don't take credit for it, etc.). If the art is reposted, then written credit and/or link-back is mandatory. If you have questions about this please contact me.
--No other ToS will override mine for my artwork. Please be aware of this and, if you cannot comply, please do not commission.

*I know sometimes things happen that are out of our control, so if the payment will be more than the 3 days, please contact me to work out the details. If this becomes a reoccurring issue, then I will be forced to hold you to the 3-day limit with no exceptions.
** Generally, if I have to change the linework there will be a fee, but something like eye color, for example, can be done for free. However, as stated earlier, this is a case-by-case basis.


STREAM RULES

--Do not ask for free art. It's just rude.
--.No murry-purry RP. Fun/flirty is okay, just no sex/yiff. Go private** with that stuff!
--Cursing is okay, just don't go overboard. The same goes for ALL CAPS.
--Link posting is fine, but, please, no spamming.
--Be nice to others! You are there to have fun! So is everyone else! Do not fight in my stream. If you have an issue with someone and want to talk about it, take it to private**.
--Please do not ask about your commission in the stream. I will not answer you. Please send me a private message.
--Please, no advertising or self-promotion in my stream. You are not there to make money in my streams.
--If the subject or someone makes you uncomfortable, don't be shy to mention it to me. So I can quickly remedy the situation
--Please feel free to talk to me, but please be aware that I may miss chunks of the chat from time to time. Please do not take it personally if I miss something or do not answer right away.
--NO DRAMA! Seriously, I don't want your drama and you sure as hell don't want mine!
--ONE STRIKE POLICY: You will get a warning. That is it. If you continue to be problematic* you will be removed.
--Have fun and don't be shy! We don't bite unless you want us to! ;)

*problematic is defined by ME. If I tell you to stop that means you stop or you WILL BE REMOVED. End of story.
**It is NOT my responsibility to tell you how to privately message someone or provide to you with their contact information.

ADOPTABLES

-- Once purchased, they are your characters. You can make any changes/alterations/edits to the design of the adoptable.
--You are allowed to repost the original adoptable image to your gallery. Please give credit for original adoptable artwork.
--You may trade the design for other designs, or resell the design for equal or lesser to what you originally paid. The exception to this rule is if there is additional artwork of the character, then you may increase the price.
--If you sell or buy a character I made please let me know! It is not required, but I like to keep tabs on my characters and see future art! it also helps solve any problems in the future about who rightfully owns a character if I can trace back its sale history.
--Profiteering will be terms for immediate repossession of the adoptable and you will be blacklisted from further adoptable and commissions.

AI Art-
under no circumstances may my art be used for AI art of any type
