THESE TERMS AND CONDITIONS ARE EFFECTIVE AS OF [4/13/2015] UNTIL FURTHER NOTICE OR IF ANY CHANGES ARE MADE

This post is to henceforth give due notice and regard to the proprietor known as IMVU. Any material on my page including but not limited to artwork, stories, journals, and all other intellectual material is under copyright to myself and to the rightful artist. Any material posted onto the FurAffinity website prior to 19 March 2015 is protected by the original ToS agreement to use of this site and no material will be redistributed or used without my legal authorization. At any time the new owners of this website alter the original ToS agreement to meet their own cooperate goals the material preexisting to the acquisition will not be used in any IMVU based sites or programs without mine or the artists legal authorization.

In the event any of my intellectual copyrighted material is redistributed on any source outside of FurAffinity you will be in clear violation of the Digital Millennium Copyright Act and will be ordered to remove it from any source outside of FurAffinity or face legal charges of copyright infringement.

By commissioning me, you are agreeing to the following terms and conditions.

YOU MUST BE 18 YEARS OR OLDER IN ORDER TO PURCHASE A NSFW COMMISSION FROM ME.
All commissions must be sent through note .

- DO NOT REMOVE MY WATERMARK OR POST WITHOUT CREDIT. I will NEVER give out unwatermarked work. This is to protect me AND you.
- Paypal only.
- American Dollars (USD) only.
- Content do's and don't's can be seen here.
- Preview/WIP at the sketch and line stage for revisions can be requested.
- No rush orders, but deadlines are okay. If you need something done by a certain date, TELL ME. It may cost a fee depending on my commission queue.
- No, you are not allowed to have the .sai or .psd versions of your commission, sorry. This rule prevents theft.
- I retain all copyrights.
- My artwork is never to be posted on: Boorus, chans, Facebook, Inkbunny. (I have my own account on e621 as 'TinyCurlyQ' and the tinycurlyq artist tag is attatched to my account.)

Please make sure you store and back up your finished commission as I cannot guarantee you that I will be able to provide it if you lose it after I have initially provided it to you. This is due to both my personal storage needs as well as potential circumstances outside of my control.

References:
PLEASE try to avoid Second Life/Word refs. They're difficult to get correct color/patterns from and I've had to re-color a commission more than once due to being given these horrid references. If you send me a reference, I work from the reference and any notes you give me in private messages. If, after the color stage, you want something added that was not originally communicated, it may cost you a fee to accommodate those changes.

Payment:
All payments must be through PayPal. Do not include any additional notes (aside from your username ONLY. Ex: tinycurlyq. Do NOT include any additional information: PayPal does NOT endorse the sale of artwork/commissions and it can end with your/my PayPal being banned and all funds seized with no return.
Please do NOT send it as a gift, or anything else under the Personal tab, as Paypal cracks down on that as well.
I cannot take payment for commissions or YCHs as anything other than 'payments for goods and services' with 'no address required'.
I cannot send invoices.
Money sent as 'send money to friends/family' will be returned UNLESS I specifically communicate that you may send payment in that way.
If any of these types of payments are made, I will refund you and contact you with instructions for the appropriate process to send payment.

All prices are in USD, and must be paid up front. Work will not begin until payment is received. In the case of mailed (or item) payment, work will not start until I have received payment. I am not responsible for money/items lost in the mail.
For orders that are over $100, I will take 50% up front, but the commission must be paid in full once you approve the sketch and the lining process begins.

Commission Procedure:
In order to commission me you must have at least one image of the character, with color. I do not accept text references. I do not accept Second Life images unless it is ALL you have and it is correct to your color/pattern specifications or you are able to work with me to confirm your preferred colors.

Once you have sent your request and we have discussed what you'd like to commission, you must pay in full up front (unless otherwise specified in these terms), and I will add you to my commission queue.
I will send you your sketch* for you to approve and at this point in time you must request any revisions. Once you have approved the sketch, I will continue on to the lineart process. Once this step is complete, I will send this to you as well to confirm your approval and discuss any final changes. Once approved, I will begin to complete your commission. At this point, no other changes can be made without a fee. The fee is determined based on the difficulty that the revision would be to make to the commission.

Please check the sketch thoroughly before approving it, as any changes past this step may cost a fee dependent on the change being made. Changes made due to my own error are exempt from fees and are done regardless of the point in the process or complexity of the change. (Ex: I forgot or missed something in the reference or that you directly communicated to me.

If an extremely complex character is requested, there may be additional charges.

I do not mimic art styles. EX: Disney, Sonic or any other artist's.

I reserve the right to refuse your commission for any reason.

Revisions:
You are able to ask for changes to your commission. However, if you ask for excessive changes, or after the lineart has been completed or the commission has been completed, there will be a fee.
Please review the sketch and any other WIPs sent to you carefully before approving to avoid this.

If you decide that you want a completely new pose, or a different character, this will cost a large fee.


Rush Orders/Deadlines:
I cannot accept rush orders. If you have a date that you would like your commission by, for whatever reason, please communicate this to me very clearly. I have a full time career and must prioritize that, so I may not be able to meet your needs and may have to decline your commission.

Permissions & Private Artworks:
I retain all rights to my art unless I state otherwise. This means that I can post it to my FA account, website, art CDs/Folios, prints, and other personal uses. Please state ahead of time if you wish for your commission to be withheld from my galleries and my own personal use. This does not mean you own the rights to the image. This does not mean that I will claim credit over your character.

You are allowed to post your commission in your gallery, but it must be linked and credited back to me. You are also able to print the image for personal use, use it for a personal tattoo, or as a graphic in a personal website or blog layout. If you're using it on a website or blog layout, I must be visibly credited. You may not upload commissions to boorus or chans, Facebook, and/or InkBunny without my permission.

You are not allowed to use my art commercially, as I still own the rights unless discussed before I accept your commission. You may not sell t-shirts, prints, or any other items with my art on it. You may not mass produce (more than one or two copies) products (Shirts, prints, stickers and so on) with the image and give them away. If you want the rights to your image, it will have to be discussed before I begin to work on your commission, as you need my permission in writing.

You may not hire (payment exchanged in return for coloring; money, items, art and so on) someone to copy any of my art in any form.

Refunds:
If you need a refund for whatever reason, then you must request it before I've started your commission. I will communicate to you clearly when I have begun working on your commission.

Please do not commission me if you do not have the funds to fully pay for the commission.
